Phobik Studio™ exists to help people create meaningful, personal, and memorable AI-generated songs and artwork.

We believe creativity can strengthen relationships, celebrate life's milestones, and help people express emotions in healthy and positive ways.

To protect our community, our technology, and the rights of others, all users must comply with this Acceptable Use Policy.

This Policy forms part of the Phobik Studio Terms of Service.

1. PURPOSE

This Policy explains how Phobik Studio may and may not be used.

It is designed to:

• protect users;
• protect intellectual property;
• protect the integrity of the Service;
• encourage responsible use of artificial intelligence; and
• ensure that Phobik Studio remains a positive creative platform.

2. OUR GUIDING PRINCIPLES

We ask every user to use Phobik Studio in a way that is:

• respectful of others;
• lawful;
• honest;
• creative;
• responsible;
• safe.

Artificial intelligence should be used to inspire creativity—not to deceive, exploit, harass, or harm others.

3. PERMITTED USES

You are encouraged to use Phobik Studio to create songs and artwork for lawful personal purposes, including:

• celebrating birthdays, anniversaries, weddings, graduations, retirements, and other milestones;
• expressing gratitude, encouragement, love, friendship, or appreciation;
• commemorating meaningful memories and keepsakes;
• creating songs for yourself or someone you care about;
• supporting personal reflection, journaling, or creative expression;
• sharing songs on your personal, non-commercial social media accounts as permitted under the Phobik Personal Creative License™.

4. PROHIBITED USES

You may not use the Service to generate, request, distribute, or facilitate content that:

Violates the Law

Including content that:

• violates criminal or civil law;
• promotes illegal activity;
• facilitates fraud;
• supports money laundering;
• promotes tax evasion;
• assists in identity theft;
• violates export control or sanctions laws.

Exploits or Harms Others

You may not generate content that:

• promotes child sexual abuse or exploitation;
• exploits or endangers minors;
• encourages human trafficking;
• facilitates sexual exploitation;
• promotes or facilitates non-consensual intimate imagery.

Promotes Violence or Terrorism

You may not use the Service to create content that:

• promotes terrorism;
• supports extremist organizations;
• incites violence;
• encourages violent criminal activity;
• glorifies mass violence or acts of terrorism.

Harasses or Threatens Others

You may not generate content intended to:

• harass;
• bully;
• stalk;
• intimidate;
• threaten;
• extort;
• defame;
• unlawfully discriminate against others.

Fraud and Impersonation

You may not use Phobik Studio to:

• impersonate another person for deceptive purposes;
• impersonate a business or organization;
• create fraudulent endorsements;
• create phishing content;
• misrepresent your identity in a manner intended to deceive others.

Intellectual Property Violations

You may not knowingly use the Service to:

• infringe copyrights;
• infringe trademarks;
• violate trade secrets;
• violate publicity rights;
• reproduce protected works without authorization;
• submit prompts designed primarily to copy copyrighted lyrics or recordings.

You may reference general genres, moods, or musical characteristics, but you may not use the Service to intentionally reproduce a specific copyrighted work.

Harmful or Malicious Code

You may not use the Service to:

• distribute malware;
• distribute ransomware;
• distribute spyware;
• facilitate hacking;
• facilitate denial-of-service attacks;
• interfere with computer systems;
• transmit malicious software.

5. MISUSE OF ARTIFICIAL INTELLIGENCE

You may not use the Service to:

• create deceptive deepfakes intended to mislead;
• generate content for unlawful scams or fraud;
• automate abusive activity;
• build competing AI datasets from Generated Content;
• reverse engineer Phobik Studio's AI workflows;
• attempt to extract proprietary prompts or internal system instructions;
• circumvent usage limits, safety features, or technical safeguards.

Artificial intelligence should be used as a creative tool—not as a means to deceive, manipulate, or cause harm.

6. INTELLECTUAL PROPERTY

Users must respect the intellectual property rights of artists, musicians, writers, designers, publishers, and other creators.

You may not:

• claim ownership of Phobik's trademarks;
• remove proprietary notices;
• copy substantial portions of the Service;
• reproduce Phobik's branding without permission;
• scrape or systematically copy Generated Content;
• misuse the Service in violation of the Phobik Personal Creative License™.

7. SECURITY & PLATFORM INTEGRITY

To protect the reliability and security of the Service, you may not:

• attempt unauthorized access to accounts or systems;
• probe or scan for vulnerabilities;
• interfere with servers or networks;
• overload or disrupt the Service;
• use automated bots to create excessive requests;
• bypass payment systems;
• circumvent account limits;
• exploit software bugs or vulnerabilities.

We may implement technical measures to prevent abuse, including rate limiting, fraud detection, automated security monitoring, and account verification where appropriate.

8. ENFORCEMENT

If we reasonably believe that a user has violated this Policy, the Terms of Service, or applicable law, Phobik may take one or more of the following actions:

• issue a warning;
• remove or restrict access to Generated Content;
• restore or reject generation requests;
• temporarily suspend the account;
• permanently terminate the account;
• revoke applicable licenses granted under the Terms of Service;
• refuse future access to the Service;
• cooperate with law enforcement or governmental authorities where legally required or appropriate.

The specific action taken will depend on the nature, severity, frequency, and impact of the conduct.

9. REPORTING VIOLATIONS

If you believe someone is misusing Phobik Studio or violating this Policy, you may contact us.

Please provide:

• a description of the concern;
• relevant dates or links, if available;
• any supporting information that will help us investigate.

We review reports in good faith but cannot guarantee a particular outcome or disclose the results of investigations involving other users.

10. CHANGES TO THIS POLICY

We may update this Acceptable Use Policy from time to time to reflect changes in law, technology, our services, or our business practices.

Material changes will become effective on the Effective Date shown at the beginning of the revised Policy.

Your continued use of the Service after such changes constitutes acceptance of the updated Policy.
