Whether you're creating a song for yourself, someone you love, or a moment you'll never forget, our goal is to help you express your story through the power of artificial intelligence.

This Personal Creative License™ explains what you may—and may not—do with the AI-generated songs and artwork created through Phobik Studio.

We've written it in plain English because we believe your rights should be easy to understand.

This License forms part of the Phobik Studio Terms of Service. By generating content through the Service, you agree to this License Agreement.

1. PURPOSE OF THIS LICENSE

Phobik Studio exists to help people create meaningful AI-generated music and artwork that celebrates memories, relationships, milestones, emotions, and personal growth.

This License is designed to give you broad freedom to enjoy and share your creations for personal, non-commercial purposes while protecting the technology, creative systems, and intellectual property that make Phobik Studio possible.

2. DEFINITIONS

For purposes of this License:

Generated Song means any lyrics, melody, arrangement, vocals, instrumental composition, or audio recording generated through the Service.

Generated Artwork means any AI-generated cover art, illustration, image, thumbnail, or visual companion created through the Service.

Generated Content means all Generated Songs, Generated Artwork, titles, descriptions, and other AI-generated outputs created through the Service.

Personal Use means use that is private, personal, non-commercial, and not intended to generate revenue, promote a business, or obtain commercial advantage.

Commercial Use means any use intended to generate revenue, support a business, advertise products or services, obtain commercial advantage, or exploit the Generated Content for financial gain.

License means the limited rights granted under this Agreement.

3. THE PHOBIK PERSONAL CREATIVE LICENSE™

Subject to your compliance with the Terms of Service and this License Agreement, Phobik Corp grants you a limited, non-exclusive, revocable, non-transferable, and non-sublicensable license to use the Generated Content created through your lawful use of Phobik Studio solely for Personal Use.

This License does not transfer ownership of the Generated Content or any underlying intellectual property.

All rights not expressly granted remain reserved by Phobik Corp and its licensors.

4. WHAT YOU MAY DO

Under the Personal Creative License™, you are welcome to enjoy your creations in meaningful personal ways.

Personal Listening

You may:

• Listen to your songs as often as you like.
• Download your songs when download functionality is available.
• Download your AI-generated artwork when available.
• Save your creations to your personal devices.

Share with Friends and Family

You may:

• Send songs by text message.
• Send songs by email.
• Share songs in family group chats.
• Share songs with loved ones.
• Give songs as personal gifts.

Share on Personal Social Media

You may post your Generated Songs and Artwork on your personal, non-commercial social media accounts, including platforms such as:

• Instagram
• Facebook
• TikTok
• X
• Threads
• Snapchat
• Pinterest
• LinkedIn (personal profile)
• YouTube (non-monetized personal use)
• Similar personal social networking platforms

You remain responsible for complying with the terms of the platform on which you share your content.

Personal Celebrations

You may use your songs during personal events including:

• Birthdays
• Weddings
• Anniversaries
• Graduations
• Memorials
• Family reunions
• Holiday celebrations
• Personal keepsakes
• Baby announcements
• Retirement celebrations
• Personal slideshows
• Home videos that are not monetized

Educational & Personal Presentations

You may use your Generated Content in:

• Classroom presentations
• School projects
• Family history presentations
• Personal journals
• Scrapbooks
• Vision boards
• Memory books
• Non-commercial creative projects

5. WHAT YOU MAY NOT DO

Unless you first obtain a separate written Commercial License from Phobik Corp, you may not use Generated Content for Commercial Use.

The following are examples of prohibited uses and are not intended to be exhaustive.

Commercial Music Distribution

You may not:

• Release Generated Songs on Spotify.
• Release Generated Songs on Apple Music.
• Release Generated Songs on Amazon Music.
• Release Generated Songs on YouTube Music.
• Release Generated Songs on Pandora.
• Release Generated Songs on Deezer.
• Release Generated Songs on TIDAL.
• Release Generated Songs on SoundCloud for monetization.
• Distribute Generated Songs through DistroKid, TuneCore, CD Baby, UnitedMasters, LANDR, Symphonic Distribution, or any similar commercial distributor.

Monetization

You may not:

• Sell your Generated Songs.
• Sell your Generated Artwork.
• Charge others to download your songs.
• Sell CDs or vinyl containing your songs.
• Sell digital downloads.
• Monetize your songs through YouTube.
• Monetize podcasts containing your songs.
• Sell NFTs incorporating Generated Content.
• Include your songs in paid subscription services.
• Include your songs in products offered for sale.

Advertising & Marketing

You may not use Generated Content:

• in advertisements;
• in commercials;
• to promote a company;
• to promote products;
• to promote services;
• to promote merchandise;
• in influencer marketing campaigns;
• in sponsored content;
• in branded social media campaigns;
• for political advertising;
• in fundraising campaigns intended for commercial benefit.

Film, Television & Media

You may not use Generated Content in:

• Motion pictures
• Television programming
• Streaming productions
• Commercial documentaries
• Advertisements
• Video games
• Mobile applications
• Podcasts that generate revenue
• Broadcast radio
• Commercial livestreams
• Professional stage productions
• Paid theatrical productions

Licensing

You may not:

• Grant synchronization licenses.
• Grant master licenses.
• Grant publishing rights.
• Sublicense Generated Content.
• Transfer commercial rights.
• Register Generated Songs with a performing rights organization (PRO).
• Claim ownership of exclusive publishing rights.
• Offer Generated Content for commercial licensing.

Artificial Intelligence

You may not:

• Use Generated Content to train another AI model.
• Build AI datasets from Generated Content.
• Reverse engineer Phobik Studio's generation methods.
• Scrape Generated Content at scale.
• Use automated tools to collect Generated Content.

6. OWNERSHIP OF YOUR PROMPTS AND OUR TECHNOLOGY

You retain ownership of the personal stories, memories, ideas, and original text that you choose to submit as prompts.

Phobik does not claim ownership of your life experiences or creative ideas.

However, Phobik retains all rights, title, and interest in and to:

• Phobik Studio™
• The Phobik® name and logo
• The Phobik Method™
• The Phobik Music Bible™
• The Phobik Studio Master Logic™
• The website design
• Software and source code
• AI orchestration systems
• Prompt engineering methods
• User interface designs
• Databases
• APIs
• Documentation
• Trademarks
• Trade dress
• Copyrights
• Trade secrets
• Other proprietary technology and intellectual property owned or licensed by Phobik.

Nothing in this License transfers ownership of these assets.

7. AI-GENERATED CONTENT

You acknowledge that:

• Your songs and artwork are generated using artificial intelligence.
• AI-generated content may not be unique.
• Similar prompts from different users may produce similar outputs.
• Generated Content may resemble existing works without intentional copying.
• Phobik cannot guarantee that Generated Content qualifies for copyright protection under applicable law.
• Copyright laws governing AI-generated content continue to evolve.

Accordingly, this License grants you rights to use Generated Content as described herein but does not represent or guarantee the availability of copyright protection or exclusivity.

8. COMMERCIAL LICENSING OPPORTUNITIES

Phobik may, at its sole discretion, offer separate commercial licensing options in the future.

Such licenses may include:

• Creator Licenses
• Business Licenses
• Commercial Creator Plans
• Wedding or Event Licenses
• Enterprise Licenses
• Synchronization Licenses
• Custom Commercial Agreements

No commercial rights are granted unless expressly provided in a written agreement signed by an authorized representative of Phobik Corp.

9. REVOCATION OF LICENSE

Phobik may suspend or revoke the Personal Creative License™ if you materially violate:

• this License Agreement;
• the Terms of Service;
• applicable law; or
• any written commercial licensing agreement with Phobik.

Upon revocation, you must discontinue any use of the Generated Content except where otherwise required by applicable law.

10. FREQUENTLY ASKED QUESTIONS

Can I share my song with my family?

Yes. We encourage it.

Can I text my song to someone?

Absolutely.

Can I post my song on Instagram or TikTok?

Yes, on your personal, non-commercial accounts.

Can I use my song at my wedding, birthday, or family gathering?

Yes. Personal celebrations are exactly the kinds of moments Phobik Studio was designed to support.

Can I put my song on Spotify or Apple Music?

No. Commercial distribution requires a separate written license from Phobik Corp.

Can I make money from my song?

Not under the Personal Creative License™. Any commercial exploitation requires a separate written agreement.

Can I sell my song or artwork?

No.

Can I use my song in an advertisement or for my business?

No.

Can I claim exclusive ownership of the AI-generated song?

No. You receive a license to use the Generated Content as described in this Agreement, but the legal status of AI-generated works is evolving, and this License does not grant exclusive ownership rights.

Who owns my personal memories and stories?

You do. Your personal experiences, memories, and original prompt text remain yours.

Why does Phobik use a license instead of saying I own the song?

Because AI-generated works involve evolving legal issues and third-party technologies. The Personal Creative License™ gives you clear rights to enjoy and share your creations while preserving flexibility as copyright laws continue to develop.
