OUR PHILOSOPHY
Phobik Studio was created to help people tell meaningful stories through personalized AI-generated music and artwork.
The standard Phobik Personal Creative License™ allows users to enjoy and share their creations for personal, non-commercial purposes.
Some individuals, organizations, or businesses may wish to use AI-generated content in ways that extend beyond personal use. This Commercial Use & Licensing Policy explains those circumstances and how commercial rights may be obtained.

1. PURPOSE
This Policy supplements the Phobik Studio Terms of Service and the Phobik Personal Creative License™.
Unless otherwise stated in a separate written agreement signed by an authorized representative of Phobik Corp, all Generated Songs and Generated Artwork are licensed solely for Personal Use.
Commercial rights are not included with the standard License.
2. PERSONAL USE VS. COMMERCIAL USE
Personal Use
Personal Use generally means using Generated Content for private enjoyment, personal expression, family, friends, or non-commercial sharing.
Examples include:
- Listening to your songs.
- Sharing songs with loved ones.
- Posting on your personal Instagram, TikTok, Facebook, or similar personal social media accounts.
- Playing songs at birthdays, weddings, anniversaries, graduations, memorials, and family gatherings.
- Including songs in personal home videos that are not monetized.
- Saving songs as keepsakes or personal memories.
These uses are permitted under the Phobik Personal Creative License™.
Commercial Use
Commercial Use generally means any use intended to generate revenue, obtain commercial advantage, support a business, advertise, market, or promote products or services.
Whether or not money changes hands immediately, a use may still be considered commercial if it primarily benefits a business, brand, organization, or revenue-generating activity.
3. EXAMPLES OF COMMERCIAL USE
The following are examples of Commercial Use requiring prior written authorization from Phobik.
Music Distribution
- Releasing a song on Spotify.
- Releasing a song on Apple Music.
- Uploading through DistroKid, TuneCore, CD Baby, UnitedMasters, LANDR, or similar distributors.
- Selling digital downloads.
- Selling physical copies.
Business Promotion
- Company advertisements.
- Brand campaigns.
- Promotional videos.
- Marketing reels.
- Business websites.
- Trade show presentations.
- Product launches.
- Commercial email campaigns.
Entertainment & Media
- Films.
- Television.
- Streaming productions.
- Video games.
- Mobile apps.
- Commercial podcasts.
- Audiobooks sold for profit.
- Paid online courses.
- Subscription content.
- Monetized YouTube channels.
Public Performance
- Ticketed events.
- Commercial venues.
- Retail stores.
- Restaurants.
- Hotels.
- Fitness studios.
- Corporate events.
- Conferences.
- Trade exhibitions.
Merchandise
- Apparel.
- Greeting cards for sale.

4. WHAT IS NOT PERMITTED
Without a separate written Commercial License, you may not:
- Sell Generated Songs.
- Sell Generated Artwork.
- License Generated Content.
- Grant synchronization rights.
- Grant publishing rights.
- Grant master recording rights.
- Register Generated Songs with a performing rights organization (PRO).
- Register Generated Songs with a music publisher.
- Claim exclusive commercial ownership.
- Sublicense Generated Content.
- Transfer commercial rights to another party.
- Use Generated Content as part of a software product.
- Include Generated Content in AI training datasets.
- Remove copyright, trademark, or proprietary notices where applicable.
5. FUTURE COMMERCIAL LICENSING PROGRAMS
Phobik may, in its sole discretion, offer one or more commercial licensing programs in the future.
Examples may include:
- Individual Creator License
- Business License
- Wedding Professional License
- Content Creator License
- Commercial Social Media License
- Advertising License
- Podcast License
- Film & Television Synchronization License
- Enterprise License
- Custom Licensing Agreement
The availability, scope, pricing, and eligibility requirements of any future commercial license shall be determined solely by Phobik.
Nothing in this Policy obligates Phobik to offer any particular license.
6. REQUESTING COMMERCIAL RIGHTS
If you wish to use Generated Content in a manner that may constitute Commercial Use, you must obtain prior written authorization from Phobik.
When submitting a licensing request, please include:
- your name or organization;
- contact information;
- a description of the Generated Content;
- the proposed commercial use;
- the intended audience;
- geographic scope;
- duration of use;
- expected distribution channels;
- whether the use is exclusive or non-exclusive (if applicable).
Submission of a request does not guarantee approval.
Phobik may approve, deny, or propose alternative licensing terms in its sole discretion.
7. ENFORCEMENT
Unauthorized Commercial Use may result in one or more of the following actions:
- suspension of your account;
- termination of your account;
- revocation of your Personal Creative License™;
- requests to remove or cease use of Generated Content;
- legal action to protect Phobik's intellectual property and contractual rights;
- any other remedies available under applicable law.
Nothing in this Policy limits any rights or remedies available to Phobik under the Terms of Service or applicable law.
8. CHANGES TO THIS POLICY
Phobik may update this Policy from time to time to reflect changes in law, technology, business practices, or licensing programs.
Material updates will become effective on the date specified in the revised Policy.
Continued use of the Service after such updates constitutes acceptance of the revised Policy.
